Massachusetts has established a robust legal framework for both medical and recreational cannabis use. This document outlines the key laws and regulations for consumers in the Commonwealth.

Recreational Cannabis (Adult Use)

In 2016, Massachusetts voters passed Question 4, legalizing the recreational use of cannabis for adults 21 and older.

Possession and Purchase Limits

Adults can legally possess and purchase the following amounts:

  • Public Possession: Up to 1 ounce of cannabis or 5 grams of concentrate.
  • Home Possession: Up to 10 ounces of cannabis.
  • Purchase Limit: Up to 1 ounce of flower, 5 grams of concentrate, or 20 servings of edibles per transaction from a licensed retailer.
Where You Can and Cannot Consume

Consumption is subject to strict regulations:

  • Legal Consumption: Private property (with the property owner's permission).
  • Illegal Consumption: Public places, federal land (including national parks), and anywhere smoking tobacco is prohibited. It is illegal to consume cannabis in a motor vehicle (even as a passenger).
Home Cultivation

Adults 21 and older are permitted to cultivate cannabis at home, subject to the following limits:

  • Individual Limit: Up to 6 flowering cannabis plants.
  • Household Limit: A maximum of 12 flowering cannabis plants, regardless of the number of adults in the residence.
Medical Cannabis

Massachusetts has a Medical Use of Marijuana Program for registered patients.

Patient Registration

To legally purchase and possess medical cannabis, a person must:

  1. Have a qualifying medical condition.
  2. Obtain a written certification from a registered physician.
  3. Register with the Cannabis Control Commission (CCC) and receive a Medical Use of Marijuana Program ID Card.
